TERMS & CONDITIONS

1. Definitions

For the purposes of these Terms & Conditions, the following terms shall mean:

Organizer – Endless Gravel Crew Sp. z o.o. (NIP 5342716299), operating under the brand Endless Gravel Crew, under the domain endlessgravelcrew.com, responsible for organizing camps and running the online store. Endless Gravel Crew Sp. z o.o. is a licenced tour operator within the meaning of the Polish Act of 24 November 2017 on Package Travel and Linked Travel Arrangements (Journal of Laws, item 2361) and is entered in the register of tour operators under the number 43855.

Camp – a cycling event organized by Endless Gravel Crew, including both international camps and weekend camps in Poland.

International Camp – an event organized outside of Poland, lasting no less than 4 days, requiring a written agreement with the participant.

Weekend Camp – an event organized primarily in Poland, with participation confirmed through registration and a deposit payment.

Participant – a natural person taking part in a camp organized by Endless Gravel Crew.

Store – the online store operating at endlessgravelcrew.com, run by the Organizer.

Client – a natural or legal person, or an organizational unit, placing an order in the Store.

Terms & Conditions – this document setting out the rules for participation in camps, use of the Store, and the use of participants’ likeness.

2. General Provisions

2.1. The Organizer of camps, group rides, events, and the operator of the online store under the domain endlessgravelcrew.com is Endless Gravel Crew Sp. z o.o. (NIP 5342716299).

2.2. The Organizer can be contacted at: info@endlessgravelcrew.com.

2.3. These Terms & Conditions define the rules regarding:

  • participation in camps organized by Endless Gravel Crew (both international and weekend),
  • use of the online store,
  • use of participants’ likeness,
  • liability of the Organizer and participants.

2.4. Participation in a camp or making a purchase in the Store constitutes acceptance of these Terms & Conditions.

3. Camps Organized by Endless Gravel Crew

3.1. International Camps

3.1.1. International camps organised by Endless Gravel Crew Sp. z o.o. that meet the statutory definition of a package travel arrangement are organised on the basis of a package travel contract concluded between the Organiser and the Participant, in accordance with applicable law.

3.1.2. Before entering into the contract, the Participant receives the standard information form and information concerning the terms and conditions of participation in the relevant camp. The detailed rights and obligations of the Participant and the Organiser are set out in the package travel contract.

3.1.3. Participation in a camp is confirmed upon payment of the amount specified in the contract by the applicable deadline. The amounts and deadlines for individual payments may vary depending on the specific camp.

3.1.4. The Participant may terminate the contract at any time before the start of the camp. In such a case, the Organiser may charge an appropriate and justified termination fee in accordance with the terms set out in the contract.

3.1.5. The amount of the termination fee may depend, in particular, on how far in advance the Participant terminates the contract, the anticipated cost savings and the possibility of using the relevant travel services for alternative purposes. At the Participant’s request, the Organiser shall provide justification for the fee charged.

3.1.6. The Participant may terminate the contract without paying a termination fee in the circumstances provided for by law, in particular where unavoidable and extraordinary circumstances occur at or in the immediate vicinity of the destination and significantly affect the performance of the package travel arrangement or the carriage of passengers to the destination.

3.1.7. The Organiser may cancel a camp and terminate the contract with the Participant in the circumstances provided for by law, in particular due to an insufficient number of participants, where a minimum number of participants has been specified in the contract, or due to unavoidable and extraordinary circumstances that prevent the package travel arrangement from being carried out.

3.1.8. If the Organiser cancels a camp for the reasons specified in Section 3.1.7, the Participant shall receive a refund of payments made, in accordance with the applicable legal requirements and deadlines.

3.1.9. The Organiser is responsible for the proper performance of the travel services covered by the contract, in accordance with applicable law. The Organiser may not exclude or limit any liability arising under mandatory provisions of law.

3.1.10. If the Participant identifies any lack of conformity during the camp, they should promptly notify the Organiser or the person responsible for delivering the camp, taking into account the circumstances of the situation.

3.1.11. The Organiser provides Participants in international camps with insurance covering at least medical expenses and personal accident insurance, in accordance with the scope specified in the contract and the insurance terms and conditions. Detailed information about the insurance, including the insurer’s details, scope of cover, insured sums and exclusions, is provided to Participants before the camp begins.

3.1.12. Additional insurance cover, in particular third-party liability or baggage insurance, may be provided where included in the relevant insurance product or the offer for a particular camp. Such cover does not form part of the guaranteed minimum scope of insurance unless otherwise specified in the contract or the camp offer.

3.1.13. The Participant is required to comply with safety rules, applicable laws and the Organiser’s reasonable instructions relating to the delivery of the camp programme, particularly those concerning participation in cycling activities.

3.2. Weekend Camps

3.2.1. Weekend camps organised by Endless Gravel Crew Sp. z o.o. are conducted in accordance with the terms specified in the offer for the relevant camp and the terms and conditions of participation provided to the Participant before booking.

3.2.2. Participation in a camp is confirmed upon payment of the amount specified in the offer or the terms and conditions of participation by the applicable deadline.

3.2.3. The amounts and deadlines for any subsequent payments, where required, are specified in the offer or the terms and conditions of participation for the relevant camp.

3.2.4. The rules governing withdrawal from a camp and any applicable withdrawal fees are specified in the offer or the terms and conditions of participation, taking into account the nature of the particular event and applicable law.

3.2.5. The Organiser may cancel a camp for the reasons specified in the offer or the terms and conditions of participation. If the Organiser cancels a camp, the Participant shall receive a refund of payments made towards participation, in accordance with the terms set out in the offer or the terms and conditions of participation.

3.2.6. The Participant is required to have a bicycle in good working order, a helmet and equipment appropriate to the nature and programme of the camp.

3.2.7. The Participant is responsible for complying with safety rules and applicable laws while taking part in the camp.

3.2.8. The Participant should have appropriate personal accident insurance. If the Organiser provides insurance as part of a particular camp, the scope of cover is specified in the offer or the terms and conditions of participation.

3.2.9. The Organiser shall not be liable for damage resulting from the Participant’s culpable acts or omissions, or for the consequences of circumstances for which the Organiser is not liable under applicable law.

4. Online Store endlessgravelcrew.com

4.1. The online store operates at endlessgravelcrew.com and is run by Endless Gravel Crew Sp. z o.o. (NIP 5342716299).

4.2. Purchases may be made by adults or minors with the consent of their legal guardian.

4.3. The order process includes: selecting products, adding to the cart, providing personal details, choosing payment and delivery options, and confirming the order.

4.4. Payments are processed via electronic payment operators or traditional bank transfers.

4.5. Delivery is carried out according to the chosen option and the price list available on the Store website.

4.6. Clients have the right to withdraw from the contract within 14 days of receiving the goods without providing a reason, by sending a declaration of withdrawal. Return shipping costs are borne by the client.

4.7. Complaints regarding goods may be submitted by email to: info@endlessgravelcrew.com . Complaints will be reviewed within 14 days.

4.8. All materials available in the Store (graphics, logos, designs) are the property of Endless Gravel Crew and protected by copyright law.

5. Use of Participants’ Likeness

5.1. During all events organized by Endless Gravel Crew, photos and video recordings are taken.

5.2. Participation in an event constitutes consent to the free use of the participant’s likeness by the Organizer and third parties cooperation with the Organizer for:

  • non-commercial purposes - publications on Endless Gravel Crew social media (Instagram, Facebook, Strava),
  • limited commercial purposes - through sharing materials on a paid photo service run by Endless Gravel Crew at http://photos.endlessgravelcrew.com/.
  • extended commercial purposes - including sharing, transferring, or selling photo and video materials featuring the participant’s image to third parties cooperating with the Organizer (in particular partners and event sponsors), for use in their marketing, promotional, and communication activities, including publication in their own channels (e.g. websites, social media, advertising materials).

5.3. The Organizer is not obliged to inform participants each time their likeness is used.

6. Liability and Safety

6.1. Participants take part in camps at their own risk.

6.2. Each participant must wear a helmet and ride a technically sound bicycle.

6.3. Each participant should be equipped with lights and basic tools.

6.4. For safety reasons, bicycles equipped with aero bars are not allowed at camps or group rides.

6.5. The Organizer is not liable for accidents or injuries resulting from a participant’s breach of safety rules.

7. Final Provisions

7.1. These Terms & Conditions are effective from the date of publication on endlessgravelcrew.com.

7.2. The Organizer reserves the right to amend these Terms & Conditions. The amended version shall apply from the moment of its publication on the website.

7.3. In matters not regulated herein, the provisions of Polish law shall apply.
